Terms of Use
These Terms of Use (hereinafter referred to as the “Terms”) define the conditions of use for the online shop (hereinafter referred to as the “Service”) provided on this website by NAMOW Inc. (hereinafter referred to as the “Company”). All registered users (hereinafter referred to as “Users”) shall use the Service in accordance with these Terms.
Article 1 (Scope of Application)
These Terms apply to all relationships between the User and the Company in connection with the use of the Service.
In addition to these Terms, the Company may establish individual rules or guidelines (hereinafter referred to as “Individual Provisions”) regarding the use of the Service. These shall constitute a part of the Terms regardless of their name.
If any provision in these Terms conflicts with an Individual Provision, the Individual Provision shall prevail unless otherwise specified.
Article 2 (User Registration)
To use the Service, a prospective user must agree to these Terms and apply for registration using the method specified by the Company. Registration is complete once the Company notifies the applicant of its approval.
The Company may refuse registration if any of the following are determined to apply, and is under no obligation to disclose the reasons:

The applicant has previously violated these Terms.

The Company deems the registration inappropriate.
Article 3 (User ID and Password Management)
Users are responsible for managing their own user IDs and passwords.
Under no circumstances may a User transfer, lend, or share their user ID and password with a third party.
If a login is made using a valid combination of user ID and password, it is considered as usage by the registered User.
The Company is not responsible for any damages arising from unauthorized use of a user ID or password by a third party, unless such use is due to the Company’s intentional or gross negligence.
Article 4 (Purchase Agreement)
A purchase agreement is deemed established when a User applies to purchase a product and the Company accepts the application.
Ownership of the product transfers to the User at the point the Company hands over the item to a shipping carrier.
The Company may cancel an order without prior notice if:

The User violates these Terms.

Delivery is not possible due to an unknown address or prolonged absence.

The Company deems the trust relationship with the User to be impaired.
Payment methods, shipping, order cancellations, and return procedures shall be as separately specified by the Company.
Article 5 (Intellectual Property Rights)
Copyrights and other intellectual property rights related to content (including product images) provided through the Service belong to the Company or other rightful owners. Users may not copy, reproduce, modify, or otherwise use such content without permission.
Article 6 (Prohibited Conduct)
Users must not engage in any of the following while using the Service:

Violating laws or public order and morals

Committing or being involved in criminal acts

Infringing intellectual property rights

Damaging or interfering with the Company's servers or networks

Commercial use of information obtained through the Service

Actions that may interfere with the operation of the Service

Impersonating another user

Providing benefits to antisocial forces, directly or indirectly

Any other conduct deemed inappropriate by the Company
Article 7 (Suspension of Service)
The Company may suspend or interrupt all or part of the Service without prior notice in the following cases:

System maintenance or updates

Force majeure (e.g., earthquake, lightning, fire, power outage, natural disaster)

System failure or communication outage

Any other reason the Company deems the Service cannot be provided
The Company shall not be liable for any damages suffered by Users or third parties due to such suspension or interruption.
Article 8 (Usage Restrictions and Deregistration)
The Company may, without prior notice, restrict a User’s access to all or part of the Service or terminate their registration if:

Any of the Terms are violated

False information is found in the registration details

The registered credit card becomes unusable

Payment obligations are not met

The User does not respond to communications for a certain period

There is no activity for a certain period

The Company otherwise deems the User unsuitable
The Company shall not be liable for any damages incurred due to such actions.
Article 9 (Withdrawal)
Users may withdraw from the Service by following the prescribed withdrawal procedure.
Article 10 (Disclaimer and No Warranty)
The Company makes no warranty that the Service is free of defects (including but not limited to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, or non-infringement).
The Company bears no responsibility for any damages incurred by Users through use of the Service. However, if the contract between the User and the Company (including these Terms) is deemed a consumer contract under Japanese Consumer Contract Law, this disclaimer may not apply. Even in that case, the Company shall not be liable for damages caused by negligence (excluding gross negligence), and only for direct and ordinary damages.
The Company shall not be involved in any disputes, communications, or transactions between Users or between Users and third parties.
Article 11 (Changes to Service Content)
The Company may change or discontinue the Service at any time without notice, and shall not be liable for any resulting damages.
Article 12 (Changes to Terms)
The Company may revise these Terms at any time without prior notice if deemed necessary. Continued use of the Service after changes implies acceptance of the revised Terms.
Article 13 (Handling of Personal Information)
The Company will handle personal information obtained through the Service in accordance with its Privacy Policy.
Article 14 (Notices and Communication)
Notices and communications between the User and the Company shall be made in a manner designated by the Company. Unless the User submits a change request, the Company will consider the registered contact information to be current and valid, and any notice sent to it will be considered delivered at the time of dispatch.
Article 15 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer or assign their contractual position under these Terms or any rights or obligations to a third party without the Company’s prior written consent.
Article 16 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
In the event of a dispute regarding the Service, the exclusive jurisdiction shall lie with the court having jurisdiction over the Company’s head office location.
