Terms of Use for Regular Delivery 1 Month Course and 2 Month Course


Beauté de Pivoine offers regular delivery of Effortless Beauty Duo/ Gentle Cleansing Gel/ All-in-One-White Gel (hereinafter referred to as "this service") within Japan .

In addition to these terms, the use of this service is subject to the terms and conditions separately stipulated by Beauté de Pivoine . In the event of any conflict between these terms and the terms and conditions separately stipulated, the terms and conditions of this service shall take precedence. Please read the entire text of these terms and conditions carefully and agree to the contents before using this service.


Once you start using this service, you will be deemed to have agreed to all of the contents of these terms and conditions.

* Due to Beauté de Pivoine 's circumstances, the contents of the actual product or sample product delivered, as well as the price, may change after ordering this service, depending on product renewals, etc. If there is a change in price or content after ordering this service, we will contact you in advance and you can choose to continue or cancel by contacting us by the specified method by the date specified by Beauté de Pivoine . If you continue using this service, such as receiving the product without contacting us after being notified of the changes, you will be deemed to have agreed to the changes.


About application

・Orders for this service can only be placed through the official online store. Please apply following the instructions provided on the official online store.


A sales contract for the Service will be established between you and Beauté de Pivoine when Beauté de Pivoine sends you an email accepting your application. However, Beauté de Pivoine reserves the right to refuse orders from customers with whom a dispute has arisen regarding a past order, customers who Beauté de Pivoine reasonably believes to have previously violated the terms and conditions set by Beauté de Pivoine , including these Terms , or who are currently involved in fraudulent activities , or customers who Beauté de Pivoine believes should not do business with for other legitimate reasons.


Delivery Information

・The first delivery is usually scheduled to be shipped within 2-5 business days after you place your order on the official online store. The second and subsequent shipments are generally scheduled to be shipped approximately one or two months after the date of your first order. You can check the next expected delivery date on the "Manage Subscriptions" screen under "orders" on your My Page.


・For the first time, we will send you an email confirming the shipment when it is shipped. From the second time onwards, we will send you a confirmation email three days before the scheduled shipping date. ・Please note that delivery may be delayed or advanced due to weather conditions, your area of residence, delivery conditions, and other circumstances.


Beauté de Pivoine will be exempt from liability by contacting the contact information registered by the customer (regarding issues due to an unknown delivery address, etc.) and by delivering the product to the address specified at the time of purchase. In addition, Beauté de Pivoine does not guarantee the period or date of delivery.


Payment

・Payment methods include credit card, bank transfer, Apple Pay, and Google Pay. Customers will be charged for their subscription at 10:00 a.m. (Japan time) on the day after their subscription is renewed.
If you pay by credit card, you will be subject to the terms of a separate contract between you and your credit card company. If a dispute arises between you and the credit card company, etc., the parties involved will resolve it, and credit cards, bank transfers, Apple Pay, and Google Pay will not be held responsible.


・Please note that orders made with credit cards will be handled as follows:

(1) If the expiration date has passed, we may cancel your subscription after giving you notice.

(2) If the card company declines to process the transaction, we may notify you and cancel your subscription.


- You can change your payment method from your My Page up to 10 days before the next scheduled delivery date.


Ownership

Title to and risk of ownership of products provided by this service via credit card, bank transfer or convenience store payment shall be transferred upon delivery of the products.


Cancellation/Skip

To use this service, you must purchase the product three times. If you cancel the service within the third time, we will charge you the difference in price.

If you wish to skip your order, please complete the procedure on your My Page at least 5 days before your next shipment.


*If you wish to cancel, please complete the procedure on your My Page at least 5 days before the next scheduled delivery date.

Returns and Exchanges

- This service does not accept returns, refunds, or exchanges of products, except in cases of damage during delivery, when the quality of the delivered product is different from that of regular products, errors in quantity, incorrect products, or cases otherwise approved by Beauté de Pivoine (collectively referred to as "non-conformity with the contract").


If the product does not conform to the contract, Beauté de Pivoine will replace it with a normal product. If such replacement is not possible, the customer may cancel this service. However, such a request for replacement and cancellation may only be made if the customer notifies Beauté de Pivoine of the non-conformity of the product within 7 days after receiving the product.


Gift wrapping

This service does not provide gift wrapping.



Changes and Termination of the Service

If Beauté de Pivoine deems it necessary, it may change or terminate the content and terms of this service (delivery contents of actual products and samples, price, shipping fee, delivery method, delivery date, etc., everything related to this service) without prior notice to customers.

However, if there is a change in the price or content of this service after you have placed your order, we will contact you in advance and ask you to choose whether to continue or cancel your order. If you continue to use this service, such as by receiving the product after being notified of the change, you will be deemed to have agreed to the change.


Cancellation

Except as otherwise provided in these Terms and Conditions, you may not cancel this service midway.


・In the event of any of the following reasons, Beauté de Pivoine may cancel this service without any prior notice or warning to the customer and without obtaining the customer's consent. In the event that any of the following reasons occur to the customer and the service is cancelled , Beauté de Pivoine shall not be liable for any damages incurred by the customer and shall not provide any compensation to the customer.


(1) If you fail to pay for the Service

(2) If the customer uses a credit card fraudulently

(3) If the use of the Service is for the purpose of resale

(4) If the customer does not respond to inquiries regarding orders for the Service

(5) If a member's membership is suspended or expelled

(6) If a petition for seizure, provisional seizure, provisional disposition, compulsory execution, bankruptcy, or civil rehabilitation is filed against you, or if you file a petition for such.

(7) If the customer violates any of the terms and conditions stipulated by Beauté de Pivoine , including these Terms and Conditions.

(8) If Beauté de Pivoine determines that the provision of the Service to the Customer is inappropriate.


Regarding damages arising in connection with this service

In relation to the Service, if Beauté de Pivoine inflicts damages on the Customer due to reasons attributable to Beauté de Pivoine , the scope of liability for damages shall be limited to the total amount of fees received from the Customer in relation to the Service by Beauté de Pivoine , and shall be limited to the ordinary damages directly incurred by the Customer as a result of the use of the Service (including, but not limited to, incidental damages, special damages, lost profits, and other indirect damages, regardless of whether they were foreseeable or foreseeable). However, this does not apply if the occurrence of such damages is due to the willful misconduct or gross negligence of Beauté de Pivoine .


Force majeure

Beauté de Pivoine shall not be liable for any delay or inability to perform all or part of the Services due to storms, heavy rains, floods, high tides, earthquakes, lightning strikes, rock falls, fires, typhoons, tsunamis or other natural disasters, wars, riots, civil wars, terrorist acts, diseases or epidemics, amendments or abolitions of laws and regulations, orders and dispositions by public authorities , strikes or other industrial action, accidents in transport or other force majeure. In such cases, the Services that could not be performed shall be automatically terminated.


Revision of these Terms

When Beauté de Pivoine makes additions or changes to the Service, or when it is necessary to change these Terms and Conditions due to amendments to related laws and regulations, the Company may change these Terms and Conditions in accordance with the Civil Code and other related laws and regulations. When changing these Terms and Conditions, the Company shall notify the Customer of the changes to these Terms and Conditions, the content of the changes, and the effective date of the changes by a method deemed appropriate by Beauté de Pivoine, such as by posting on the website or email , at least 21 days prior to the changes. When changing these Terms and Conditions, all matters related to the use of the Service after the effective date shall be governed by the changed Terms and Conditions, including for Customers before the changes. Customers who do not agree to the changes to these Terms and Conditions may terminate all use of the Service by notifying the Company at least 5 days prior to the scheduled delivery date of the Service after the above notification date.


If you use the Service after the revision, you will be deemed to have agreed to the revised Terms.


Effectiveness

・Even if any provision of these Terms and Conditions is determined to be invalid based on laws and regulations, the remaining provisions shall remain valid.


・Even if any provision of these Terms and Conditions is invalid or cancelled in whole or in part with respect to a specific customer, these Terms and Conditions will remain valid with respect to other customers.


Governing Law and Jurisdiction

・These terms and conditions shall be governed by Japanese law.


- In the event of a dispute regarding these Terms of Use, the Tokyo District Court shall be the court of first instance with exclusive jurisdiction.
